Using AI Responsibly in your Business


Lawyers have a lot of ethics rules. One rule that doesn’t exist: how to ethically use artificial intelligence (AI). I bet your industry doesn’t have AI governance either.


Should you use artificial intelligence in your business? It can run your website customer chat or provide market research. You could generate interview questions or automate your sales funnel.


The body that regulates NC lawyers (the State Bar) takes the approach that existing ethics rules govern new technologies.


Generative AI is a set of algorithms, capable of generating content —such as text, images, or audio—from the training data.


This is a leap forward from semantic AI programs that can sort through and organize existing data sets or libraries of information. It’s the difference between searching for answers and having the program create a plain-language analysis to your question.


The framework for how lawyers use technology is now being applied to AI.


We must be competent in knowing the strengths and weaknesses of any tool we use. We must use technology responsibly, effectively and appropriately.


We look at AI like we look at employees, and must provide adequate supervision of both. We therefore supervise the research results from AI the same way we would supervise the work from a legal assistant. We cannot rely on AI without reviewing the answers. We must understand the parameters of the AI technology and how it uses the information we provide. What are the security and privacy protocols of the program? What would happen if we entered confidential client information into the question? The parameters are different when you use something like ChatGPT vs Lexis Nexis legal tools.


We must be aware of bias and fairness to make sure we are providing unbiased legal services.


We must communicate transparently to our clients about our use of technology, including AI. We also have to bill fairly and transparently.
